By accessing or using Variantly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Your use of the Service constitutes your acceptance of these Terms.

2. Description of Service

Variantly is an AI-powered platform that enables users to generate multiple variants of advertising creatives. The Service allows you to:

  • Upload images and content for variant generation
  • Generate multiple ad variants using AI technology
  • Download and use generated variants for commercial purposes
  • Manage your account, subscriptions, and credits

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered through various subscription plans with different credit allocations and features. Subscription fees are billed in advance on a monthly or annual basis, as selected by you.

4.2 Payment Terms

  • All fees are non-refundable except as required by law or as explicitly stated in our refund policy
  • You authorize us to charge your payment method for all fees associated with your subscription
  • If payment fails, we may suspend or terminate your access to the Service
  • Prices are subject to change with 30 days' notice to existing subscribers

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We offer a 30-day money-back guarantee for new subscriptions. Refund requests must be submitted within 30 days of the initial purchase.

5. User Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive, worldwide license to:

  • Store and process Your Content to provide the Service
  • Generate variants based on Your Content
  • Display Your Content within the Service interface

Important: We do not use Your Content to train AI models or share it with third parties except as necessary to provide the Service.

5.2 Generated Variants

You own all rights to variants generated from Your Content. You may use generated variants for any commercial or non-commercial purpose without attribution to us.

5.3 Prohibited Content

You agree not to upload content that:

  • Violates any law, regulation, or third-party rights
  • Contains illegal, harmful, or offensive material
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or other harmful code
  • Is used to generate misleading, fraudulent, or deceptive content

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, redistribute, or sublicense access to the Service
  • Use the Service to compete with us or build a similar service

7. Service Availability and Modifications

We strive to provide reliable service but do not guarantee that the Service will be available 100% of the time. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or outages
  • Force majeure events

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any loss or damage resulting from such modifications or discontinuation.

8. Disclaimers and Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • Defects in the Service will be corrected

8.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, revenue, data, or business opportunities
  • Costs of substitute services
  • Damages resulting from use or inability to use the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Variantly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the Service, violation of these Terms, or infringement of any rights of another.

10. Termination

10.1 Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through your account settings.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you:

  • Violate these Terms or our policies
  • Engage in fraudulent, abusive, or illegal activity
  • Fail to pay subscription fees
  • Use the Service in a manner that harms us or other users

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data, subject to our data retention policies. Provisions of these Terms that by their nature should survive termination shall survive.

11. Governing Law and Dispute Resolution

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
